Trump's first AI executive order (January 23, 2025): revokes Biden's EO 14110, orders review of all actions taken under it, and directs development of a new AI Action Plan within 180 days

Executive Order 14179 is the first AI executive order of the second Trump administration. Signed January 23, 2025 and published January 31, 2025 (90 FR 8741), its primary operative effect is to revoke Biden's Executive Order 14110 (RESCINDED) (Safe, Secure, and Trustworthy AI, October 30, 2023) and to order a review of all actions taken under it. The order characterizes the prior regime as ideologically biased and as an obstacle to innovation, and directs the development of a new AI Action Plan within 180 days.

Key provisions

Section 1 (Purpose) declares that AI systems should be "free from ideological bias or engineered social agendas," and frames competitiveness and innovation as the primary policy goals.

Section 3 (Definition) adopts the statutory definition of AI from 15 U.S.C. § 9401(3), the same definition used in the CHIPS and Science Act.

Section 4 (AI Action Plan) directs the Assistant to the President for Science and Technology (APST), the Special Advisor for AI and Crypto, and the Assistant to the President for National Security Affairs (APNSA) to develop an AI Action Plan within 180 days, that is, by approximately July 22, 2025.

Section 5 governs the rollback of EO 14110. Subsection (a) orders immediate review of all policies, regulations, orders, and actions taken under EO 14110; any actions "inconsistent with, or present[ing] obstacles to" the new policy of AI dominance are to be suspended, revised, or rescinded. Subsection (b) directs OMB, within 60 days, to revise M-24-10 and M-24-18 (Biden's AI guidance memoranda) to align with the new policy. The revisions called for in Section 5(b) are the subject of the OMB Memorandum M-24-10 and OMB Memorandum M-24-18 pages.

Scope and effect

EO 14179 does not establish new affirmative AI requirements. It is primarily a rollback-and-reset order, clearing the field for the subsequent action plan and positive-policy executive orders that follow. The substantive Trump AI policy is set out in Executive Order 14365 and the AI Action Plan (America's AI Action Plan).

The order is the first in a sequence of Trump-era AI executive orders: EO 14179 (January 23, 2025), revoking Biden's order and ordering review; EO 14319 (July 23, 2025), on preventing "woke AI" in federal procurement; EO 14320 (July 23, 2025), on promoting the export of American AI technology; and EO 14365 (December 2025), a comprehensive national AI policy framework.
